When is a person entitled to cessantia (severance pay)?

A person is eligible to receive severance pay:

a.    When an employee has been laid off or terminated other than by his fault.

b.    When an employee is laid off or terminated by the fault of the employee, but due to the circumstances of the employer.

c.    When an employer can no longer pay their employees due to bankruptcy, or a moratorium being enforced, or when the employer ceases to exist.

It is important to know that first and foremost it is the responsibility of the employer to pay out the severance pay, not SZV.
