Anyone who works for an employer is an employee except:

- Employees who personally take on work, but who are considered employers by the SZV
- Parents and living-in children of the employer unless it is a a normal employment
- Household personnel
- Workers at home
- Captain of a Sint Maarten ship
- Civil Servant
- Owner and spouse of a sole proprietorship
