The legal company official (Director) can automatically assign the Admin rights in the Employer Portal to a 3rd party. The legal company official assigns user rights to the company's internal users (employees) and external users (accountants). The principle of solidarity funds the Social & Health insurances of St. Maarten. This means that all persons contribute by paying a premium percentage. For employers, the type and amount of premium will vary based on different factors.

You qualify as an employer if you employ one (1) or more persons, meaning they work for you and receive wages. Everyone who has one or more employees executing labor is an employer. There are three possibilities:

You are established in Sint Maarten and have employees executing labor for you on Sint Maarten. You are established in Sint Maarten, and your employees are executing labor for you outside Sint Maarten (Dutch Caribbean). A foreign company can also be categorized as an employer in Sint Maarten (Dutch Caribbean).

The director, or in the case of a sole proprietorship, the company owner can do the registration personally or authorize someone to perform this task. Click here for the required documents for company registration.

When your company ceases operations or is made inactive, you must inform SZV immediately so that we can deactivate your company in our system. Company deactivation can be requested within your Employer Portal account.

The employer must ensure that their employee registry at SZV is up to date. Via the Employer Portal, the employer can register new employees and submit mutations/changes of current employees. Examples include Commencements, Mutations (extension of contracts, job function, salaries, and so on), and Terminations.

The employer has the right to receive loss of wages compensation under the ZV Ordinance for his employee, if:

The employee is sick for more than three (3) days and cannot perform their duties.The Control Doctor of SZV confirmed the illness.

Loss of Wages can be requested within your Employer Portal account.

By law, all employers must pay an annual contribution, for each registered employee, towards the Cessantia fund. This amount is ANG 40,- per employee and is due each year before June 30. The total amount due by the employer is calculated based on the employee registry of the company. It is made available via the Employer Portal each year in June.

Employers may submit a protest or appeal within their Employer Portal account.
